A-002 Waiver and Release of Liability

VOLUNTEER WAIVER AND RELEASE AGREEMENT

Please read carefully before signing. This is a release of liability and waiver of certain legal rights.

In consideration for my being permitted to participate in training or other events organized by the Washington State Animal Response Team (WASART), I agree to the following Waiver and Release of Liability.

I acknowledge that handling or being near horses, llamas, alpacas, goats, pigs, sheep, dogs, cats and any other animals where training or other activities occur, have inherent risks, hazards, and dangers for anyone that cannot be eliminated.  I UNDERSTAND THAT THESE RISKS, HAZARDS, AND DANGERS INCLUDE WITHOUT LIMITATION:

  1. The propensity of an animal to behave in ways that may result in injury, harm, or death to persons on or around them;
  2. The unpredictable nature of an animal’s reaction to such things as sounds, sudden movement and unfamiliar objects, persons, or other animals;
  3. Certain hazards such as surface and sub-surface conditions;
  4. Collision with other animals or objects;
  5. The potential of the participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animals or not acting within his or her ability.
  6. Temperature extremes;
  7. Inclement weather conditions and the unavailability of immediate medical attention in case of injury.
  8. Possible exposure to contagious or zoonotic diseases

I understand the risks, hazards, and dangers described above and have had the opportunity to discuss them with an event organizer(s).  I understand that these activities may require good physical conditioning and a degree of skill and knowledge.  I believe I have that good physical conditioning and the degree of skill and knowledge necessary for me to engage in these activities safely.

My participation in these activities is purely voluntary.  No one is forcing me to participate, and I elect to participate in spite of the risks.  I AM VOLUNTARILY PARTICIPATING IN THE ACTIVITY ORGANIZED OR SPONSORED BY WASART WITH FULL KNOWLEDGE OF THE INHERENT RISKS, HAZARDS, AND DANGERS INVOLVED AND HEREBY ASSUME AND ACCEPT ANY AND ALL RISKS OF INJURY, ILLNESS, PARALYSIS OR DEATH.  IF MY ANIMALS ARE PARTICIPATING IN THE ACTIVITY ORGANIZED OR SPONSORED BY WASART, I AKNOWLEDGE THAT I AM VOLUNTARILY PERMITTING MY ANIMALS TO PARTICIPATE IN SAID ACTIVITY AND ACCEPT ANY AND ALL RISKS OR INJURY, ILLNESS, PARALYSIS OR DEATH THAT MIGHT OCCUR TO MY ANIMALS.

In addition, I hereby release and discharge WASART from all actions, claims or demands that I, my marital community if such exists, my heirs, distributes, guardians, legal representatives or assigns may have for injury or damage resulting from my assistance in the said disaster.

I, and my animals participating in said activity sponsored by WASART, are in good physical health and have the ability to safely engage in WASART sponsored or organized activities. 

If less than eighteen (18) years of age, parent, guardian, or custodian must sign the indemnification Form (A-5)

I HAVE CAREFULLY READ, CLEARLY UNDERSTAND, AND VOLUNTARILY SIGN THIS WAIVER AND RELEASE AGREEMENT.
